Property Disputes Between Spouses

Property-related matrimonial disputes often involve ownership questions, document review and negotiation. A clear understanding of the evidence and legal position can support better decision-making during disputes or settlements.

Indian law does not automatically divide all property equally on divorce. Ownership generally follows title and contribution, while the wife has specific rights over her stridhan and a right of residence in the shared household. Property terms are therefore usually decided through settlement or specific legal claims.

This page covers property questions between spouses only. General land, ancestral property and builder disputes are outside the matrimonial and family-law focus of this website.

Stridhan and Matrimonial Property

Stridhan — gifts given to a woman before, at or after her marriage — is her absolute property. Section 27 of the Hindu Marriage Act allows the court, in matrimonial proceedings, to make provisions for property presented at or about the time of marriage that may belong jointly to the spouses.

Under the Domestic Violence Act, a woman cannot be dispossessed from the shared household except in accordance with law. Jointly owned property and joint loans are usually dealt with by agreement in a mutual consent divorce.
