Mutual Consent Divorce in Lucknow: Process, Documents and Legal Considerations

When a marriage has broken down and both spouses accept that it cannot continue, a mutual consent divorce is usually the most dignified and least expensive way to end it. This guide explains how the process generally works at the Family Court in Lucknow, which documents are usually needed, and what to settle before you file.

Who Can File for Mutual Consent Divorce?

For marriages under the Hindu Marriage Act, 1955, Section 13B allows a husband and wife to file a joint petition if they have been living separately for at least one year, have not been able to live together, and have mutually agreed that the marriage should be dissolved. "Living separately" refers to not living as husband and wife — it does not always require different addresses. Similar provisions exist under Section 28 of the Special Marriage Act, 1954 and other personal laws.

Consent must be free and genuine. If either spouse is pressured, or consent is withdrawn before the final decree, the mutual divorce cannot proceed on that basis.

The General Process at the Family Court

  • Settlement terms — the spouses agree on alimony, stridhan, custody, visitation and the withdrawal of other cases, ideally in writing.
  • Joint petition — a petition signed by both spouses, with supporting affidavits, is filed before the Family Court having jurisdiction.
  • First motion — both spouses appear and their statements are recorded.
  • Waiting period — the law provides six months before the second motion. In Amardeep Singh v. Harveen Kaur (2017) the Supreme Court held that the court can waive this period in suitable cases.
  • Second motion and decree — both spouses confirm their consent and the court, if satisfied, passes a decree of divorce.

Documents Generally Required

Every case is different, but the following are commonly needed:

  • Marriage certificate or other proof of marriage such as the invitation card and wedding photographs
  • Identity and address proof of both spouses
  • Proof of separate residence where available
  • Details of children, if any
  • The agreed terms of settlement
  • Recent passport-size photographs of both spouses

What to Settle Before Filing

Most problems in mutual divorces arise from vague settlements. Payment of permanent alimony is often split between the first and second motions so that neither side is exposed. The return of stridhan should list the items. Custody and visitation should be specific — days, holidays, school events and video calls — and all pending cases between the spouses and their families, such as maintenance or domestic violence applications, should be addressed.

Can the Divorce Be Completed Sooner?

If the conditions laid down by the Supreme Court are met — for example where the spouses have already lived separately for a long period, mediation has failed and all issues are resolved — the Family Court can be requested to waive the six-month waiting period. Whether a waiver is granted depends on the facts and the court's discretion.
