A contested divorce — sometimes called a one-sided divorce — is filed by one spouse on grounds recognised by law and opposed by the other. Advocate Nidhi Singh represents both petitioners and respondents in contested divorce cases before the Family Court, Lucknow, from drafting the petition or written statement through evidence, cross-examination and final arguments.
Contested divorce often runs alongside maintenance, custody or domestic violence proceedings, and these need to be handled consistently.
Under Section 13 of the Hindu Marriage Act, 1955, grounds include cruelty, desertion for a continuous period of at least two years, adultery, conversion to another religion, certain forms of mental disorder, and renunciation of the world, among others. A wife has some additional grounds. Other personal laws and the Special Marriage Act have their own grounds.
The spouse who files must prove the ground with evidence — documents, messages, witnesses and the party's own testimony. The Family Court will usually also refer the parties for counselling or mediation, and many contested cases ultimately convert into a mutual consent divorce.

Contested cases involve pleadings, evidence and several hearings, so look for an advocate who explains the grounds, likely stages and risks realistically, and keeps you informed. No lawyer can guarantee the result of a contested case.

Cruelty and desertion are the grounds most often relied on. Others include adultery, conversion and certain mental disorders. Which grounds are available depends on your personal law and facts.

Yes. If the spouses reach a settlement during the case, they can file for mutual consent divorce and the contested petition is usually withdrawn or disposed of accordingly.
यह सबूत, गवाहों, सुनवाई की तारीखों और समझौते की संभावना पर निर्भर करता है। आम तौर पर एकतरफा तलाक में आपसी सहमति वाले तलाक से अधिक समय लगता है।
